5 Day Notice to Pay Rent or Lease Terminates ?ˆ“ Residential - This form is used by a landlord to demand payment of overdue rent from a residential tenant within 5 days from giving the notice, in accordance with the laws of your state. (Note: If a written agreement provides for a longer notice, use the notice length stated in the agreement). "Residential" includes a house, apartment, or condo. If the tenant fails to pay within 5 days, the lease may be considered terminated by the landlord. The tenant is informed that the tenant must either pay the rent or suffer possible termination. If he does not pay, the landlord may begin eviction proceedings. If the landlord does not elect to proceed with termination or eviction, but instead agrees to accept rent after the termination date stated in the notice, the lease is generally reinstated.
20 Day Notice to Remedy Breach or Lease Terminates for Residential Property - If there is a material noncompliance by the tenant with the rental agreement or a noncompliance with Section 34-18-24 materially affecting health and safety, the landlord shall deliver a written demand notice to the tenant, specifying that unless the breach is remedied within twenty (20) days of mailing of the notice, the rental agreement shall terminate upon a specified date, which shall not be less than twenty-one (21) days after the mailing of the notice.
20 Day Notice to Remedy Reoccurring Breach or Lease Terminates for Residential Property - This form provides notice to the tenant that a recurring breach of the lease agreement must be remedied within 20 days or the lease agreement will be terminated. Should the tenant remedy the breach within the permitted period, the lease will not terminate. However, should the tenant not remedy the breach, the lease is terminated without further notice.
