Unfortunately, if you are in Ontario, there is no sharing of family property among common law spouses. Each spouse keeps whatever is in their name.

In Ontario, common-law spouses have the same rights to spousal support as married couples: as long as they have been living together for at least three years, or. if they have a child together and have been living together in a relationship of some permanence.

Unmarried couples do not go through divorce like married couples do if they split. As long as unmarried partners can agree on how to divvy up any assets, there's generally no need for lawyers or courts.

Common law couples are not legally required to split property acquired when they lived together. Furniture, household items and other property belong to the person who bought them. Common law couples do not have the right to split an increase in value of the property they brought with them to the relationship.

Short- or long-term spousal support, also called separation maintenance (or alimony in a divorce) may be required if one partner is financially reliant on the other. You may also be entitled to spousal support if your marriage lasted a certain period of time, or because of a variety of other factors.

For marriage/cohabitation periods of more than 20 years, or where the marriage is longer than 5 years and the age of the recipient plus the years of marriage is 65 years or more, (“Rule of 65”), support duration will be indefinite.

For example, common law partners are entitled to share property rights and benefits, such as pensions and insurance, and are also entitled to spousal support if the relationship ends. In Ontario, the Family Law Act outlines guidelines for determining spousal support in common-law relationships.

For married couples, this splitting of Canada Pension credits is mandatory, unless the spouses have a separation agreement that provides otherwise. For common-law couples, the split is not mandatory, but either spouse can apply to have their credits split.

The amount of support ranges from 1.5 to 2 per cent of the difference between the spouses' gross income amounts for each year of marriage or cohabitation, up to a maximum of 50 percent, (where 50 percent represents an equalization in income).
