Description

Cooperative apartments are different from individually owned subdivision properties, ordinary leaseholds, and condominiums. In subdivisions, each individual owns a home in fee. In an ordinary leasehold, the lessee holds no ownership interest in the lessor. In condominiums, each owner holds fee interest in a particular unit, together with an undivided fee interest in the common areas and facilities.

Cooperatives are often formed by members paying a membership fee or purchasing shares of stock. In a stock cooperative, members are issued stock certificates as evidence of their membership and capital investment. More than one type of stock may be issued. An apartment cooperative will typically be a corporation renting apartments to people who are also owners of stock in the corporation. The apartment complex is owned by the corporation.

Due to the proprietary nature of members' or stockholders' interests in the venture, substantial restrictions are generally imposed on lessee's rights to assign and sublease. Typically, assignment and sublease require consent of the board of directors of the corporation after examination of the suitability of the prospective assignee or sublessee.

FAQ

Real Property Law Section 226-b in conjunction with the Rent Stabilization Law gives tenants the right to sublease their apartment for a period of two out of every four years. In order to sublease an apartment, it is necessary that prior to the subleasing that the apartment be the tenants' primary residence.

Consent from the landlord A tenant must get a landlord's written permission to sub-let or transfer any part of the property. If a tenant does this without consent, they are breaching the terms of the tenancy agreement.

In a sublease, there are three parties: the landlord, the original tenant (sublessor), and a new tenant (sublessee). The original tenant remains responsible to the landlord, while the sublessee pays rent to the sublessor and occupies the property under the terms agreed upon in the sublease.

Before setting up a sublease, the current tenant should seek written consent from their landlord. In New York, landlords generally need to approve a sublease, unless the lease explicitly allows it. This process often involves notifying the landlord of the intent to sublease and obtaining their approval.

No tenant may sublet an apartment without the written consent of the landlord. If you did not consent to the sublease then it is not valid or enforceable. Your remedy is to terminate your tenant's lease, which will also terminate any subleases.

In California, if you are the only person on the lease and your roommate is not listed, you are considered the "master tenant" and your roommate is considered a "subtenant." As the master tenant, you have the right to evict your subtenant, but you must follow the proper legal procedures.

Step 1: Check your lease Check your rental agreement or lease documentation for specific rules on subletting your apartment. Step 2: Send landlord a letter Send your landlord or building manager a certified letter asking permission to sublet, and wait for approval. Keep copies of all communications.
