The Federal Tort Claims Act prescribes a uniform procedure for handling of claims against the United States, for money damages only. In order to complete your claim, you must complete all blocks of the attached Standard Form.(SF) 95, Claim For Damage, Injury, or Death. Claimants who wish to file an administrative tort claim against CBP should complete a Standard Form 95, Claim for Damage, Injury, or Death and submit it. Notice of the claim against the public body generally must be filed within 90 days after the incident giving rise to the claim. The claim is not required to provide more than the minimal details of the facts involved in the incident in order to give the government sufficient notice. In other words, you will have to prove additional disability (damage) which resulted from the malpractice. The Standard Form 95 requires you to complete the amount of the claim for which you are submitting as well as additional information. (a) Filing an initial claim.
