A court may grant a declaratory judgment or decree in a civil case, if it will serve to terminate the uncertainty or controversy giving rise to the proceeding. Courts have traditionally held that an insurance company has no right to intervene in the liability action against the insured to seek a coverage determination.Should not entertain an action for declaratory relief. . . . The insurer may attempt to have its duty to defend resolved in a declaratory judgment action. The owner's liability insurance carrier denied coverage because of a pollution exclusion. Id. The owner filed a declaratory judgment action against the insurer. For the aforementioned reasons, this Court concludes that Icarom's declaratory judgment action presents a justiciable controversy ripe for judicial resolution.
