A writ of replevin is a prejudgment process ordering the seizure or attachment of alleged illegally taken or wrongfully withheld property. The Circuit Court has a form for the Complaint for a Writ of Replevin.The basic process in a replevin action is: 1. FORM OF NEW YORK CITY PRE-REPLEVIN LETTER. Replevin is a court action to recover the possession of personal property. Personal property is any property that is not land or buildings. In order to succeed on the motion, the plaintiff's claim for interim possession would have to outweigh any harm or injury potentially caused to the defendant. Attached are the forms you need to file to begin an action for replevin. These forms must be filled out and submitted to the Clerk of the Court together. Rule 2 does not affect the various remedies that previously have been available in the courts of Mississippi.
