Replevin is an effective civil remedy to get your dog back. A writ of replevin is a prejudgment process ordering the seizure or attachment of alleged illegally taken or wrongfully withheld property. The process of starting a replevin action usually begins with filing a complaint. Your hearing date will be set at least sixty (60) days out from the date of filing your case. This should be filed in the Justice Court. Once filed, you will request a form called a Summons. Plaintiff Eliott Adams is seeking an emergency prejudgment writ of replevin to regain possession of his dog Fenrir from defendant Aundrea Delgado. A plaintiff in a lost pet dispute may seek an injunction to recover the pet, damages for harm done to the pet, or declaratory judgment of ownership. By: Craig H. O'Neill.
