Filing either a replevin or a detinue does not require the services of a lawyer. To initiate the replevin process with your attorney, you will file a Complaint form, a Show Cause Order, and a Request for Service. All replevin actions in Maryland must be filed in the District Court of Maryland. Without a lawyer, no one is going to do this for you. Representing yourself in an even "simple" case is NOT a simple feat. The Clerk's Office has prepared information to assist people representing themselves in this Court, including identifying various legal resources. A person claiming the right to immediate possession of personal property may file an action under this Rule for possession before judgment. The plaintiff files a complaint form with the court. Many, but not all, court forms are available through the Maryland Judiciary website. First, you should hire an experienced attorney who has filed replevins in the past and who understands the ins and outs of the law.
