You must fill out an Answer, serve the plaintiff, and file your Answer form with the court. Generally, this is due within 30 days after you were served. The Answer requires you to respond to each allegation of the Complaint. There are very specific rules and procedures for filing and serving court paperwork, which are strictly enforced. The most common documents are the complaint, answer and motions. A verified complaint does not require an affidavit or notarization. It does require a declaration under penalty of perjury. Even if the plaintiff were to file a verified complaint, the defendant in this type of case does not have to file a verified answer. Your written response must be in proper legal form if you want the court to hear your case. If you do file a verified complaint, the defendant's answer must also be verified.
