Most employers in New York City are not allowed to deny you a job, suspend you, or fire you because of your pending arrest or criminal conviction.The Division of Human Rights complaint form is available at the below link. You may use this form to file and submit your complaint online. You have a right to work, regardless of any criminal record or accusations in your past. Under New York law, employers and state agencies that issue licenses cannot reject you simply because you have a criminal conviction. If you have been arrested or convicted of a crime in New York, you still have employment rights. Before you fill out an application, it's a good idea to check the laws in your state. If you are denied a job shortly after disclosing a criminal conviction, you should speak with an employment attorney. As of July 2021, amendments to the Fair Chance Act have significantly broadened protections for individuals with criminal records.
