The Illinois Human Rights Act prohibits discrimination, harassment, sexual harassment, and retaliation against individuals in connection with employment, real estate transactions, access to credit, public accommodations, and education.

Employers with 50 or more employees qualify as “large.” Under the law, a full-time employee is defined as someone who works 30 hours or more per week. Full-time equivalents, or FTEs, will also count toward a business' full-time employee total. Two employees, each working 15 hours per week, will count as one FTE.

This means that employees cannot be scheduled for more than six (6) days in a row and employers are required to provide one 24-hour rest period within seven consecutive days. This rule applies to all full-time workers in Illinois, with just a few exceptions which we will discuss later in this article.

Definition of full-time employee For purposes of the employer shared responsibility provisions, a full-time employee is, for a calendar month, an employee employed on average at least 30 hours of service per week, or 130 hours of service per month.

"Full-time employee" means an individual who is employed for a basic wage for at least 35 hours each week or who renders any other standard of service generally accepted by industry custom or practice as full-time employment.
