To get a stay, you must file an "Application for Stay of Execution of Writ of Restitution. There are charities and nonprofits throughout the state that may be able to provide financial assistance with rent.The landlord must file a "Complaint in Summary Ejectment" with the clerk of court. In court, the landlord must prove that grounds for eviction exist. In North Carolina, your landlord can evict you if you're behind on your rent, if you've violated your lease terms, or if your lease has expired. The Emergency Rental Assistance program provides funding for government entities to assist households unable to pay rent or utilities. You can file anything you like, but the bottom line is that you are responsible for paying your rent on time, not some assistance program. Help is available from the Pitt County Department of Social Services and other sources. If the guest is not evicted in the 75 days, then you will have to file a new (or "alias") writ. Remember, the U.S. Marshals must be present during the eviction.
