For drivers in California, accident forgiveness isn't an option. Proposition 103, which passed in the state in 1988, outlaws “excessive” insurance rates and accident forgiveness was deemed excessive as you're essentially paying for coverage on an accident that hasn't happened yet.

How Long Does Accident Forgiveness Last? Accident forgiveness can be a valuable addition to basic auto coverage, but it's not a license to crash. In most cases, accident forgiveness is only valid for one collision. If you're at fault in subsequent collisions, you can expect a hike in your premium.

California Law Forbids Insurers to Raise Rates There are exceptions to prop 103 (most notably if you make multiple uninsured motorist claims in a short amount of time) but this binding legal precedent takes much of the worry out of filing an uninsured motorist claim.

Accident forgiveness does NOT mean your rates won't go up in the future. It simply means you will not be surcharged for the accident. Your rates will continue to increase at the same rate they would have if you didn't have the accident.

Accident Forgiveness is per policy, not per driver. If you have multiple drivers on your policy, any of the eligible drivers may use this benefit once; after an eligible driver uses it, the benefit is no longer available for that policy.

Stay on the Record – Your accident will still appear on your record regardless of whether it's forgiven. If you ever switch insurance, your accident could still impact your premiums in the future, as they can see the accident on your record.

However, under California's proposition 103, insurance companies are not allowed to raise rates or drop a person because they made an uninsured motorist claim.
