A declaratory judgment is a court-issued judgment that defines and outlines the rights and obligations of each party in a contract. A declaratory judgment provides a strategic means of resolving uncertainty, such as when claims are imminent.These rules govern the procedure for obtaining a declaratory judgment under 28 USC §2201. Rules 38 and 39 govern a demand for a jury trial. A declaratory judgment can be filed when the validity a marriage is denied or doubted. A plaintiff seeking a preliminary injunction must establish that he is (1) likely to succeed on the merits, (2) that he is likely to suffer irreparable harm. A declaratory judgment is a binding judgment from a court defining the legal relationship between parties and their rights in a matter before the court. Plaintiffs are therefore entitled to a declaratory judgment that Sections 1 and 5 of Arkansas Act 372 are unconstitutional, void, and of no effect.
