In this session, students will examine the historical context and the drafting of the Fourth Amendment. The 4th Amendment protects Americans from arbitrary arrest and unreasonable search and seizure, rights that had been violated under British rule. Illegal searches or seizures under the Fourth Amendment are conducted without probable cause. These protections are grounded in state law and the Fourth Amendment to the U.S. Constitution. The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated. The Supreme Court could emphasize the need for lower courts to give more deference to the word "unreasonable" in the Fourth Amendment.
