The Fourth Amendment protects your privacy – specifically, "in their persons, houses, papers, and effects. The Fourth Amendment prevents the police from stopping you and searching your person, home, or car unless certain criteria are met.Probable cause is the cornerstone of the search warrant. Probable cause is present when the police officer has a reasonable belief in the guilt of the suspect based on the facts and information prior to the arrest. The Fourth Amendment requires the government to obtain a warrant based on probable cause to conduct a legal search and seizure. Or probable cause in the absence of a warrant. Have them fill out the empty 4th Amendment charts attached to their case summaries. c. The Fourth Amendment also requires that any arrest be based on probable cause, even when the arrest is made pursuant to an arrest warrant. Show the 4th Amendment to the US Constitution, and Article 1 Section 7 of the Washington State Constitution. Allow 5 minutes for presentation.
