In lawsuits seeking equitable relief there is no right to a jury trial; ingly, these types of cases are tried to the judge in a bench trial.

If you are selected to serve on a trial, you must remain for the duration of jury selection and the trial. Once your service is completed, you will not be eligible to be selected again for three years.

If you have a compelling reason to be excused from jury service (extreme inconvenience or undue hardship), you must notify the jury office in writing. Any request must be prepared by the juror and detail the hardship. You may include any attachments you deem appropriate to aid the Court in rendering a decision.

Cases which involve more than $20,000 must be filed in the Law Division of the Superior Court. Generally, you can present your case without an attorney, unless you are a corporation, in which case you must be represented by counsel or your case will be dismissed.

In general, the statute of limitations for a contract action is 6 years and for a personal injury action is 2 years. You should be aware, however, that various factors may alter these time periods.

Special Civil is limited to cases in which the demand is $20,000 or less. If you believe you are entitled to recover more than $20,000, your case should be filed in the Law Division of the Superior Court.
