India Code: Protection of Human Rights Act, 1993. Long Title: An Act to provide for the constitution of a National Human Rights Commission, State Human Rights Commissions in States and Human Rights Courts for better protection of human rights and for matters connected therewith or incidental thereto.

The Court is based in Strasbourg, in the Human Rights Building designed by the British architect Lord Richard Rogers in 1994 – a building whose image is known worldwide.

The legislation played a crucial role in enabling the California genocide, in which thousands of Native Californians were killed or enslaved by white settlers during the California gold rush.

In India, the appropriate protection of the “Human Rights Act 1993” has been provided by the establishment of the “Human Rights Courts”. The purpose of these kinds of courts is to provide a “speedy trial” for arising any offences for not maintaining human rights.

When establishing descent from an Indian tribe for membership and enrollment purposes, the individual must provide genealogical documentation. The documentation must prove that the individual lineally descends from an ancestor who was a member of the federally recognized tribe from which the individual claims descent.

The Supreme Court of India is the apex judicial body under the Constitution of India. Article 124 of the Constitution states that “There shall be a Supreme Court of India.” The Supreme Court came into existence on 26 January 1950 with the coming into force of the Constitution.

There are currently 109 federally recognized Indian tribes in California and several non-federally recognized tribes petitioning for federal recognition through the Bureau of Indian Affairs - Office of Federal Acknowledgement (OFA) . Tribes in California currently have nearly 100 separate reservations or Rancherias.

The Bureau of Indian Affairs uses a blood quantum definition—generally one-fourth Native American blood—and/or tribal membership to recognize an individual as Native American. However, each tribe has its own set of requirements—generally including a blood quantum—for membership (enrollment) of individuals.
