This document provides guidance regarding the Pregnancy Discrimination Act and the Americans with Disabilities Act as they apply to pregnant workers. Pregnancy discrimination is against the law.The EEOC enforces three federal laws that protect job applicants and employees who are pregnant. Pregnancy discrimination is also considered sex discrimination. Nothing in the Pregnancy. Discrimination Act, or Title VII, obliges employers to accommodate the child-care concerns of breast-feeding female. Title VII of the Civil Rights Act of 1964 forbids employers from discriminating based on race, color, religion, sex, or national origin. Section 1557 of the Affordable Care Act (ACA) requires covered entities to post notices of nondiscrimination and availability of language assistance. The Equal Employment Opportunity Commission is issuing this final rule and interpretive guidance to implement the Pregnant Workers Fairness Act. Harris sued Santa Monica, claiming pregnancy discrimination.
