Constitutional Amendments – Amendment 7 – “The Right to Jury Trial in Civil Affairs” Amendment Seven to the Constitution was ratified on December 15, 1791. It protects the right for citizens to have a jury trial in federal courts with civil cases where the claim exceeds a certain dollar value.

The Seventh Amendment provides as follows: “In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than ing to the rules of the common law.”

In civil trials, both the plaintiff and the defendant have the constitutional right to a jury trial. Civil juries consist of no fewer than six and no more than 12 members, not including alternate jurors. All verdicts must be unanimous, unless the parties agree otherwise – an option not available in criminal cases.

You are expected to conduct yourself with reserve and courtesy, and when appearing at the courthouse, must dress appropriately to preserve the dignity of the Court. Proper attire includes coat and tie for men and similarly appropriate attire for women. No jeans, polo shirts or sneakers.

In Nassau County, jurors who are not involved in a voir dire or trial are excused after one or two days. Those who are selected on a jury are required to serve on only one trial. On average, the length of a civil trial ranges from one or two days. Criminal trials average slightly longer.

Proper dress attire is required when serving on jury duty. Please do not wear shorts, cutoffs, tank tops, jeans, sandals or halter tops. Metal detection screening is required of any individual entering the court building. Please refrain from carrying all forms of sharp instruments or weapons.
