New York State Constitution Article 1 §2 Right to trial by jury; waiver thereof. Although the right to a jury trial in civil cases at law is rooted in English common law and was important during the colonial era, it initially was omitted from the Constitution. The First Congress, however, ultimately adopted the right as one of the Bill of Rights, which became effective in 1791.

Amendment Seven to the Constitution was ratified on December 15, 1791. It protects the right for citizens to have a jury trial in federal courts with civil cases where the claim exceeds a certain dollar value. It also prohibits judges in these trials from overruling facts revealed by the jury.
