National Human Rights Commission of India (abbreviated as NHRC) is a statutory body constituted on 12 October 1993 under the Protection of Human Rights Ordinance of 28 September 1993. It was given a statutory basis by the Protection of Human Rights Act, 1993 (PHRA).

Role of the Judiciary It is constitutional mandate of judiciary to protect human rights of the citizens. Supreme Court and High Courts are empowered to take action to enforce these rights. Machinery for redress is provided under Articles 32 and 226 of the constitution.

The Supreme Court of India is the apex judicial body under the Constitution of India. Article 124 of the Constitution states that “There shall be a Supreme Court of India.” The Supreme Court came into existence on 26 January 1950 with the coming into force of the Constitution.

The Court is based in Strasbourg, in the Human Rights Building designed by the British architect Lord Richard Rogers in 1994 – a building whose image is known worldwide.

India Code: Protection of Human Rights Act, 1993. Long Title: An Act to provide for the constitution of a National Human Rights Commission, State Human Rights Commissions in States and Human Rights Courts for better protection of human rights and for matters connected therewith or incidental thereto.

In India, the appropriate protection of the “Human Rights Act 1993” has been provided by the establishment of the “Human Rights Courts”. The purpose of these kinds of courts is to provide a “speedy trial” for arising any offences for not maintaining human rights.

Section 2(1) (d) of the Protection of Human Rights (PHR) Act defines Human Rights as the rights relating to life, liberty, equality and dignity of the individual guaranteed by the Constitution or embodied in the International Covenants and enforceable by courts in India.

Both Civil and Criminal cases can be filed before any High Court and District Court of the country wherever the e-Filing system is adopted as on date.
