Under the Act, a plaintiff is required to present evidence that he or she (1) suffers from a disability, (2) is a qualified individual, and (3) was subjected to an adverse employment action because of the disability.

The Americans with Disabilities Act (ADA) of 1990 provides comprehensive civil rights protections to individuals with disabilities in the areas of employment, state and local government services, public accommodations, transportation, and telecommunications.

The ADA only prohibits discrimination on the basis of disability. It makes it unlawful to refuse to hire a qualified applicant with a disability because he is disabled or because a reasonable accommodation is required to make it possible for this person to perform essential job functions.

If you believe that you have been discriminated against because of your disability or denied a reasonable accommodation for your disability, you can file a complaint with the New York State Division of Human Rights.

Reasonable accommodation can include, but is not limited to, the following: Changing job duties. Providing leave for medical care. Changing work schedules. Relocating the work area. Providing mechanical or electrical aids.

To file a complaint: Visit the Division's website, at DHR. NY.GOV, and file online or download a complaint form.Mail Fill out and send the paper ADA Complaint Form. A charge of discrimination can be completed through our online system after you submit an online inquiry and we interview you. If you are denied a request for a non-employment, disability-related accommodation, you may file a grievance. A charge of discrimination generally must be filed within 180 days of the alleged discrimination. You may already know that charges of employment discrimination may be filed with the federal Equal Employment Opportunity Commission (EEOC). Acts discriminating against an employee based on these reasonable accommodations and disability rights are prohibited. You must file a charge with the EEOC before filing a federal disability discrimination lawsuit. You may have up to 300 days to file a charge if there is a State or local law that provides relief for discrimination on the basis of disability.
