This document provides information regarding employers' obligations to not discriminate against job applicants and employees because of their criminal history. Most employers in New York City are not allowed to deny you a job, suspend you, or fire you because of your pending arrest or criminal conviction.This webpage contains resources for job applicants and employees with an arrest or conviction record, and employers who are considering whether to hire them. Fill out the complaint form, answering all of the questions completely. The Justice Center notifies the provider of service of the applicant's criminal history, and the provider will make the final employment decision. Local Law 4 (2021), which takes effect July 29, 2021, adds new employment protections for workers with a record of criminal system involvement. Criminal background checks involve searching through police records, court documents, and sex offender registries. If you ask applicants for criminal history information, consider waiting until later in the hiring process to do so. The OASAS criminal background check process is not an employment screening tool.
