The Majority Opinion The McDonald decision was a close one, with a 5-4 majority. Justice Samuel Alito, Jr. wrote the majority opinion and was joined by Chief Justice John Roberts and Justice Anthony Kennedy. Justices Antonin Scalia and Clarence Thomas wrote their own concurring opinions.

Justice Stephen G. Breyer, joined by Justices Ruth Bader Ginsburg and Sonia Sotomayor, also dissented. He argued that there is nothing in the Second Amendment's "text, history, or underlying rationale" that characterizes it as a "fundamental right" warranting incorporation through the Fourteenth Amendment.

So long as undocumented immigrants in the United States have developed substantial connections with the United States, the Second Amendment confers to them a right to bear arms.
