A person commits assault by: 1. Intentionally, knowingly or recklessly causing any physical injury to another person; or 2.Lack of Causation: another one of elements to the crime of assault is that the defendant caused physical injury or fear of physical injury. 1. If the person causes serious physical injury to another. 2. If the person uses a deadly weapon or dangerous instrument. 3. Aggravated assault, however, may be charged when your simple assault of another person results in serious physical injury. Under Arizona Revised Statute section 13-1203, you can be convicted of assault when you've touched someone in a harmful way. Arizona allows prosecutors to charge people based on biting, slapping, pinching, or hitting. Recklessly and knowingly causing somebody physical injury. Intentionally or knowingly assaulting someone is a Class 1 misdemeanor in Arizona if it results in physical injury to the victim.
