Rule 56(a) requires that each motion for summary judgment be accompanied by an “Affidavit of Undisputed Facts” which sets forth the material facts relied upon in support of the motion. If the moving party fails to file and serve the affidavit, the summary judgment motion will be denied.

This act was passed to assert the authority of the British government to tax its subjects in North America after it repealed the much-hated Stamp Act. The main thrust of Rule 57 is that actions for declaratory judgment are to be brought in accordance with the Rules.The Declaratory Act of 1766 declared that the British Parliament had the absolute right to tax colonies in North America.
