It allows a court to look at the parties conduct, intent, and written agreements to determine the parties rights, responsibilities, and obligations. This act was passed to assert the authority of the British government to tax its subjects in North America after it repealed the much-hated Stamp Act.A plaintiff lacks standing if he or she is not a party to a written agreement to bring a declaratory judgment claim related to the written agreements. The Declaratory Act of 1766 declared that the British Parliament had the absolute right to tax colonies in North America. A declaratory judgment is an equitable remedy in the nature of an injunction.
