A landlord must house and store the tenant's belongings for 30 days after the tenant has abandoned the premises. In order for a title to be issued on an abandoned motor vehicle, the abandoned motor vehicle law requires the vehicle to be sold at a public sale.The first step is to determine if the unit is truly abandoned. Georgia has a ZERO day wait period after eviction before any items left behind are considered abandoned and up for grabs. If the tenant refuses or fails to give up possession, the landlord can file a Dispossessory Affidavit. Some leases clearly state that a landlord may dispose of a tenant's remaining property upon abandonment. A writ of possession is issued to evict an occupant from the property. Any funds remaining in the registry of the court shall be distributed to the parties in accordance with the judgment of the court. After a judge grants a writ of possession, the tenant has 5 days to remove all of their personal property from the rental unit. Personal property is generally considered to be abandoned when it is found in a place where the property's true owner intended to leave it.
