Under the final Noncompete Rule, the FTC adopts a comprehensive ban on new noncompetes with all workers, including senior executives. Essentially, noncompete clauses limit an employee's opportunity to excel in whatever skill or trade they're familiar with.On December 22, 2023, New York State Governor Kathy Hochul vetoed the bill that would ban all new noncompetition agreements for workers in New York. The final rule bans employers from offering or entering into new noncompete arrangements with all "workers," regardless of position or compensation. Non-compete agreements are contracts between workers and firms that delay employees' ability to work for competing firms. On April 23, 2024, the US Federal Trade Commission voted 32 to finalize and promulgate a rule banning most noncompete clauses in employeremployee contracts. Compete agreement is a contract where an employee agrees not to compete with an employer after the employment period is over. The Democratic-controlled FTC approved the ban on noncompete agreements in a 3-2 vote in May.
