Washington's non-competition agreement law governs when a non-competition agreement may be considered valid or enforceable under state law. Washington enacted a noncompete statute which, among other things, required employers to satisfy notice obligations and compensation thresholds. In 2019, the Washington legislature passed a bill that substantially limits covenants not to compete ("noncompetes"). In 2019, Washington passed a law restricting the use of post-employment non-competition covenants for certain employees. Ever since 2020, noncompete agreements that do not meet certain standards are void in Washington State. Governor Jay Inslee signed the bill into law on March 13, 2024, updating and clarifying Washington law regarding restrictive covenants. In other words, noncompete clauses cannot be enforced in smaller sale of business transactions. Washington State is making a few important amendments to its existing noncompete statute.
