The Judicial Council has created forms for requesting a continuance for restraining order cases. A 1050 motion to continue is a request in a criminal case to postpone a court date.The date could be for a pretrial matter or a trial. It permits a party opposing summary judgment or adjudication to ask to continue the motion to obtain evidence essential to the opposition. Prosecutors may file a motion for continuance, but they may not unduly delay a criminal trial, which would result in the accused not receiving a speedy trial. Rules of Ct., Rule 3.1332(c)(7)). Also, some states limit the number of continuances a prosecutor can get in light of protecting victims. Best to file this in writing with the clerk of the court AND send a copy to the other side. Counsel may not stipulate to a continuance of a TSC, MSC or Trial without Court approval.
