If you or the other side want to ask the court to do something in a case, you must ask in written court papers called a Motion or an Order to Show Cause. The forms can be filled in on the computer.Best to file this in writing with the clerk of the court AND send a copy to the other side. If you want a jury trial, you must file a. "jury demand" and pay the jury fee at the time that you file your answer. Nothing stops you from filing a motion for continuance. You file it with the clerk of courts. A continuance is the postponement of a hearing, trial, or other scheduled court proceeding at the request of either or both parties in the dispute. If you don't agree to a continuance you will have to get another lawyer. It would take that lawyer several weeks to get up to speed.
