FAQ

Currently, Florida law requires that anyone who provides child care in their home for more than one unrelated family must be either registered or licensed through the Department of Children and Families.

The Office of Child Care Regulation in the Department of Children and Families is statutorily responsible, per Florida Statutes 402.305, F.S. and Florida Administrative Code 65C-22, F.A.C., for the statewide administration of the child care licensing program in 62 of Florida's 67 counties.

While Florida has no law for a minimum age to babysit, most experts say age 12 is a good age to consider light babysitting responsibility such as an hour or so while parents run an errand. However, there are several other factors to consider before allowing your child to care for siblings or other children.

For children from birth through 1 year of age, there must be one child care personnel for every four children. 2. For children 1 year of age or older, but under 2 years of age, there must be one child care personnel for every six children.

Licensed capacity A maximum of three children from birth to 12 months old, and other children for a maximum of six children. A maximum of six preschool children if all are older than 12 months. A maximum of ten children, if no more than five are preschool age and, of those five, no more than two are under 12 months old.

Basic requirements Operator must first have been licensed as a family day care home for two consecutive years within five years of the date of the application for a license to operate. Operator must have a valid staff credential for one year prior to licensure. Operator must be at least 21 years old and reside in the home.
