Timeframe for discovery If you are the plaintiff, you can begin discovery 10 days after you serve the first papers in the case or anytime after the defendant files a response. If you are the defendant, you may begin discovery as soon as the case is filed.

If you want to file a motion, the process is generally something like this: You write your motion. You file your motion with the court clerk. The court clerk inserts the date and time your motion will be heard by the judge. You “serve” (mail) your motion to the other side.

For evidence to get admitted in criminal trials, it must be relevant, material, and competent. This means the evidence must help prove or disprove some fact in the case. You must submit copies of your evidence to the court and to each party in your case at least 10 days prior to the hearing.
