Novation. If an original contract is replaced with a new one through the mutual agreement of all parties, the original contract is void. The obligations under the original contract are extinguished, and the terms of the new agreement then bind the parties.
Contract Assignment. (a) A contract assignment must be made as part of an ownership change, a change in tax status, or a transfer from one legal entity to another through a legal process. No assignment is effective until approved, in writing, by the Texas Department of Human Services (DHS).
The enforceability of a Texas contract relies on several factors. The first one being mutual agreement between the parties, where they both accept and understand the definite terms stated in an offer. If both parties do not completely agree on the terms, then the contract is considered invalid.
Mutual Assent: A "Meeting of the Minds" of Offer & Acceptance. A legally recognized offer and an acceptance create a "meeting of the minds", or mutual assent, between the parties. The law requires the parties to a contract to demonstrate mutual assent to the contracts' terms.
Real estate license holders are required to use these forms. However, TREC contract forms are intended for use primarily by licensed real estate brokers or sales agents who are trained in their correct use. Mistakes in the use of a form may result in financial loss or a contract which is unenforceable.
As a general rule, Texas is a “right to work” or “employment at will” state, which means that employees and employers are not required to enter into employment contracts. An “at will” employee can end his or her employment for any reason at any time.

With only extremely narrow exceptions relating to certain regulated industries or collective bargaining agreements, adults, as well as youths ages 16 or 17, may work, and/or may be required to work, unlimited hours each day (the only limits are employee morale, practical realities, and common sense in general).
"Contracts for Deed" - Contracts for deed, sometimes referred to as "rent to own" financing arrangements, are legal in Texas.
Section 112.036 - Rule Against Perpetuities (a) The rule against perpetuities applies to an interest in a trust other than a charitable trust. (b) For purposes of this section, the effective date is the date the governing instrument creating an interest in the trust becomes irrevocable with respect to that interest.
