The Fourth Circuit held that while an arbitration provision cannot waive judicial review, it can waive appellate review of the arbitrator's decision. Each Appellee may file a crossappeal with the AAA within seven (7) days after notice of filing of a Notice of Appeal .The Appeal Procedure (Rule 8.2) establishes relatively narrow grounds for appeal beyond the statutory grounds under Section 10 of the Federal Arbitration Act. You cannotat least in any meaningful sense of the word"appeal" an FAAgoverned arbitration award to a court. The court drew a line between the right to judicial review and the right to appellate review of an arbitration award. But while there is nothing permitting alternative paths in the words, there is a history of federal courts finding wiggle room. There is no right to appeal in arbitration like there is in court.
