This document formally notifies tenants that they need to vacate the property within 60 days. To ensure legal validity, the notice must be written, include the specific vacate date, and be properly delivered—either in person, to someone of suitable age at the residence, or via certified mail.

YOU ARE HEREBY NOTIFIED that effective SIXTY (60) DAYS from the date of service on you of this notice, the periodic tenancy by which you hold possession of the premises is terminated for No Fault Just Cause, at which time you are required to vacate and surrender possession of the premises.

Here are the general steps involved: Serve an eviction notice: Begin by serving your family member with a written notice to vacate the property. File an eviction lawsuit: If your family member does not comply with the notice, you'll need to file an eviction lawsuit, also known as an unlawful detainer action.

If you don't do what your landlord asks, they can start an eviction case to ask the judge to order you to move out. After the landlord gives you the Notice it can take 30-45 days, or longer, for the eviction case to end. If you lose the case, the judge can order you to move out of your home.

If you have lived in the rental unit for over one year, then you will receive a 60-day notice to quit, which gives you 60 days to move out of the rental unit (see Cal Code of Civ. Proc. §§ 1946 and 1946.1). This is not permitted with a Housing Choice Voucher or section 8.

If you serve the notice on Monday, Tuesday is the first day. Count all days, including weekends. The renter has until the following working day to leave on Saturdays, Sundays, and court holidays.
