I did filled a motion to vacate pursuant to Maryland rule 2535 (b) seeking courts revisory power and to vacate dismissal with prejudice. If the dismissal is "with prejudice" then they cannot refile and the case is forever barred.A case that is dismissed "without prejudice" is only dismissed temporarily. This temporary dismissal means that the plaintiff is allowed to re-file charges. You can dismiss with prejudice for no reason, or list the reason as the parties have settled. No judgment having been entered, I dismiss this action with prejudice. This dismissal is without prejudice. Dismissal without prejudice means you can refile the case later. Generally, you can absolutely dismiss a case at any time. I would request a dismissal "without prejudice" if you may have any desire to revise the claim.
