The dismissal was without prejudice, but the trial court expressed "no opinion as to whether any re-filed action would be timely or untimely. If you do not receive any of those benefits, then you may be required to fill out the Civil.Dismissal with prejudice means that the plaintiff cannot refile the same claim again in that court. Unless otherwise specified in the order, a dismissal under this subsection is without prejudice. The Court will dismiss Defendant Mecklenburg County and the Clerk Defendants with prejudice. The court may grant the continuance if an agreement can be reached allowing the plaintiff time to see his son in the period of time before the trial. A case dismissed with prejudice is over and done with, once and for all, and can't be brought back to court.
