First, the statute to which you referred that is often characterized as the sunshine law is the New York Open Meetings Law.

For an executive session to occur, a motion must be made in public that states a specific reason for the members to meet in private. Open meetings and executive sessions. (a) Every meeting of a public body shall be open to the general public, except that an executive session of such body may be called and business transacted thereat in ance with section ninety-five 1 of this article.
