Procedural safeguards are put in place to ensure that parents are notified of everything regarding their child, ensure mediation and due process during disputes, give parents control in placement decisions, as well as maintain confidentiality.
Children who are trying to "fill the power gap" may be more prone to tantrums, physical aggression, "rudeness" and explosive outbursts. Another problem is that children whose parents disagree sometimes learn to play one parent off the other to get what they want.
Evaluation timeline The entire evaluation process must be completed within 60 calendar days (not including summer vacation) from the date you give permission by signing and returning the “Request for Consent” form given to you by your school. The date the school receives the form is when the timeline begins.
If parents disagree with the results of the assessment conducted by the school district, they have the right to ask for and obtain an independent educational evaluation (IEE) at public expense.
You may notify the Special Education Division of the California Department of Education (at 1-800-926-0648) if you feel you have a complaint or a due process issue . You must file a complaint or request for a due process hearing for the issue to continue.
Pull out your copies of official documents, including your child's current IEP, recent progress reports, and report cards. Collect samples of your child's homework, tests, and notes from the teacher. Gather your own notes and observations, too. (An IEP binder is a convenient way to keep all this stuff in one place.)
If you don't agree with the results of the school's evaluation of your child, you have the right to request an IEE “at public expense.” An IEE is conducted by an outside professional who isn't employed by the school. You need to put your request in writing.
If a parent refuses to consent to the evaluation, the school may pursue consent through mediation or the due process system.
Recommended: Complete the student's initial IEP in its entirety within 60 days unless one of the exceptions above applies. Notice of procedural safeguards. Inform parents of procedural safeguards “at each” IEP meeting.
