In the affidavit of non service, the process server meticulously records the due diligence exercised in attempting to locate and serve the recipient. Depending on the type of legal case, various actions can follow, including proceeding with the case and potentially entering a judgment against the subject in absentia.
An Order to Show Cause consists of a top page called an Order to Show Cause (OSC), followed by an Affidavit in Support of the OSC, and copies of any documents that the moving side (movant) thinks would help the Judge make a decision. The OSC tells the court and the other side what the movant wants the Judge to do.
Proof of service shall specify the papers served, the person who was served and the date, time, address, or, in the event there is no address, place and manner of service, and set forth facts showing that the service was made by an authorized person and in an authorized manner.
If proof of service of the summons has not been filed within 60 days of the complaint's filing, the court may dismiss the action without prejudice.
If substituted or nail and mail service were used, the affidavit of service must be filed with the County Clerk within 20 days of the date of service.
An eligible consensual case that was commenced and continued in hard copy form may be converted to a NYSCEF case by filing a Stipulation and Consent to E–Filing (found on the website) with the court. Any such conversion should be done promptly after commencement.
Although affidavits of service are not otherwise required to be filed, courts generally require that they be submitted and/or filed to assure that the Defendant has been given notice of the action or proceeding.
