In general, County Courts, sometimes called "the people's courts", are courts of limited jurisdiction where minor criminal (misdemeanor) and civil cases are heard. In the Circuit Courts, which are the highest state trial courts in Florida, major criminal (felony), civil, family, juvenile and probate matters are heard.

By Florida law, the Clerk of Courts in each county is the official custodian of court records. County Civil Court has jurisdiction over claims up to and including $50,000. A County Civil case is any civil matter that falls within the jurisdiction of County Court.

Federal case files are maintained electronically and are available through the internet-based Public Access to Court Electronic Records (PACER) service. PACER allows anyone with an account to search and locate appellate, district, and bankruptcy court case and docket information. Register for a PACER account.

As long as the proceeding was not sealed, anyone may obtain a transcript. To obtain a written transcript of a proceeding where a court reporter was present, contact the court reporter listed in the minutes of the proceeding.

Pursuant to Chapter 119, Florida Statutes, requests for public records may be submitted in person, by mail, online submission form, email or telephonically. A public records request does not have to be in writing as a prerequisite for completing a public records request.

In Florida, almost anyone can get a copy of a deceased person's will from the state register of will. The custodian of the will (who may or may not be the same person as the personal representative of the estate) must submit the will to the state register of wills within ten days of finding out about the death.

How can I see or obtain a copy of a will? At this time, the Florida Supreme Court does not allow public internet access for viewing imaged court documents. Images of probate court documents are available for viewing at any of the Clerk's locations on the public view terminals.
