The Chair takes a vote on the Request for Permission to Withdraw a Motion. If a majority of those present and voting are in favor of withdrawing the motion, then it is withdrawn. If a majority are not in favor, then the group continues discussing the motion.

If one party to a case has filed a motion with the court, the other side can file an “opposition.” An “opposition” is a written statement explaining to the judge why the other side is not entitled to whatever he is asking for in his motion. It is your opportunity to oppose the other side's request.

A case is withdrawn when the DA says that they are not moving forward on the charges, a case is dismissed by a court when either (1) there is insufficient or inadequate evidence, (2) the DA asks for it to be dismissed, or (3) there was some agreement for the case to be dismissed.

Withdrawal of Motions Motions may be withdrawn by the filing of a “Notice of Withdrawal” with the Court at least two (2) court days before a scheduled hearing. A proposed order need not be filed in connection with such a notice.

If, at any time after the petition is filed, the petitioner desires to withdraw the same, he shall file with the hearing clerk (or, if filed during the course of a hearing, with the judge) a written request for permission to withdraw.

(1) Notice of Intent To Withdraw. The attorney shall file and serve a Notice of Intent to Withdraw on all other parties in the proceeding. The notice shall specify a date when the attorney intends to withdraw, which date shall be at least 10 days after the service of the Notice of Intent To Withdraw.
