FAQ

Be Clear: Be direct and get straight to the point. Clearly state that you are terminating the attorney and briefly state the reasons why. Additionally, the termination letter should state that the attorney should immediately stop working on any pending matters.

Write a letter saying “I no longer require your services, send me a final bill and my client file.” Write an email saying “I no longer require your services, send me a final bill and my client file.” Have your new attorney do any of the above for you.

You do not need to follow any sort of specific template—just simply state that you are no longer in need of their services and that you are terminating them. Make sure to keep a copy for yourself, and provide your new lawyer with one, too.

City / State / Zip Code Dear Client Name: In ance with Local Rule ______________, this letter shall serve a notice of our intent to withdraw from our representation of you in _______________________ case name, cause number. As you know, we are terminating our representation due to ________________________.

RE: Termination of Legal Services Dear Mr. Lawyer, I have decided to terminate our current legal relationship immediately and have accepted legal counsel elsewhere. I am terminating this relationship because I have been calling your office for three months and have received no updates on my case status.

I am writing to officially notify you that I am terminating your services immediately. This is because {reason(s) for terminating the representation}. You do not have permission to send any demands on my behalf and I am advising the insurance company that you no longer represent me for this personal injury claim.

The proposed order relieving counsel must be prepared on the Order Granting Attorney's Motion to Be Relieved as Counsel-Civil (form MC-053) and must be lodged with the court with the moving papers. The order must specify all hearing dates scheduled in the action or proceeding, including the date of trial, if known.

There are several possible options. One would be to hire another attorney. Another would be to check into whether your attorney sent in a representation letter to the court or Solicitor's Office. If so, the attorney may have to file a Motion with the Court to be relieved as counsel on your case.

Client Consent: The simplest way is if you, as the client, agree to the attorney's withdrawal. The attorney should provide you with a request to withdraw in writing, and you can give your consent, also preferably in writing.
