Be Clear: Be direct and get straight to the point. Clearly state that you are terminating the attorney and briefly state the reasons why. Additionally, the termination letter should state that the attorney should immediately stop working on any pending matters.

Write a letter saying “I no longer require your services, send me a final bill and my client file.” Write an email saying “I no longer require your services, send me a final bill and my client file.” Have your new attorney do any of the above for you.

You do not need to follow any sort of specific template—just simply state that you are no longer in need of their services and that you are terminating them. Make sure to keep a copy for yourself, and provide your new lawyer with one, too.

There are several possible options. One would be to hire another attorney. Another would be to check into whether your attorney sent in a representation letter to the court or Solicitor's Office. If so, the attorney may have to file a Motion with the Court to be relieved as counsel on your case.

(1) An attorney may request withdrawal by filing a motion to withdraw. Unless the court orders otherwise, the motion need be served only on the party represented and the attorneys directly affected. (2) The proof of service need not include the address of the party represented.

For example, lawyers are required to withdraw when their client demands that they assert a frivolous claim or when the representation will otherwise violate the Rules of Professional Conduct. See Cal. Rules of Prof'l Conduct R. 1.16(a)(1) and 3.1.

If a lawyer and client cannot work together effectively, it can be difficult to achieve a positive outcome. In this case, the lawyer must notify the client of their intention to withdraw and provide reasonable notice to allow the client to find a new lawyer.
