You may choose to file your own Family Court petition. To do so, go to the website listed below and choose the type of petition you want to file. Completed petitions must be filed with the General Clerk of the Family Court (631-853-4289).

A custodial parent may file a petition with their local child support agency. That petition will then be forwarded to the New York City Law Department office in the county where the non-custodial parent resides. This matter will then be litigated in the New York City Family Court located in the same borough.

If you want to file a motion, the process is generally something like this: You write your motion. You file your motion with the court clerk. The court clerk inserts the date and time your motion will be heard by the judge. You “serve” (mail) your motion to the other side.

In some circumstances, you file a petition or a motion. The court has several complaint forms that you may use in drafting your complaint. The forms are available online and at the Pro Se Intake Unit. You may also write your own complaint without using a court form.

(1) "Pleading" means a petition, complaint, application, objection, answer, response, notice, request for orders, statement of interest, report, or account filed in proceedings under the Family Code.

After the case is commenced and all parties have received notice of its existence, papers may usually be served with less formality. A person 18 years of age or older and who is not a party to the case shall serve papers, but mailing or delivering papers to the office of the attorney is permitted.

Pleadings usually are presented via a written delivery of the parties. Pleadings may include briefs, attachments, responses and motions. State procedural rules (for instance, see Chapter 7 of California's Code of Civil Procedure) govern the pleading stages within state courts.
