Evicting a tenant in Florida typically takes between two to four weeks. The process starts with providing a notice to the tenant, which can vary from three days for non-payment of rent to seven or fifteen days for other lease violations. If the tenant does not comply, the landlord can file an eviction lawsuit.
On average, an eviction process takes about 15 days if there are no valid defenses to the eviction action. An eviction occurs when a tenant has breached the terms of the tenancy in some material way, or has refused to move out once the rental agreement has expired. An eviction is different from an ejectment.
The Miami-Dade County Clerk of the Courts provides online access to court records, including court dockets. You can visit their website and navigate to their online case search portal. Once on the portal, you can search for court dockets by case number, party name, attorney name, or other relevant details.

The original Notice should be sent to the County Recorder, P.O. Box 011711, Flagler Station, Miami, Florida 33101.

In ance with Florida Statutes 713, for any improvement to any real property that exceeds $5,000 including materials and labor, a notice of commencement must be filed before commencing work. The notice of commencement must be filed with the Clerk of Court.

The NOC must be signed by you, the owner contracting the improvements, and not your agent. The NOC must be completed and recorded within 90 days before starting the work. If improvements described in the NOC are not actually started within 90 days after the recording, a new NOC must be recorded.
