A payoff request allows a third party to receive the current balance due to release a lien or facilitate a business transfer (bulk sale transfer or liquor license). To release a lien or facilitate a bulk sale transfer, businesses must be in good standing to receive a payoff request.

In North Carolina, a lien claimant has 120 days from the date of last furnishing to complete these 3 steps: Fill out a mechanics lien form that meets NC requirements. File the lien with the county recorder's office. Serve a copy of the lien on the property owner.

Common notification methods include sending multiple unpaid bills in the mail but these bills can be lost or not reach the appropriate person before a lien is placed. They can also arrive when the previous homeowner was at the property but cease by the time a new homeowner moves in.

In Minnesota, an action to enforce a mechanics lien must be initiated within 1 year from the date of the lien claimant's last furnishing of labor or materials to the project. If a claimant records their lien close to Minnesota's 120-day filing deadline, they will have about 8 months to enforce the claim.

Since a lien enforcement is a lawsuit, it follows that it proceeds just like a lawsuit does. The foreclosure suit must be drafted (with all necessary parties listed as defendants), filed in court, and served on all parties.

(b) Time of Filing. – Claims of lien on real property may be filed at any time after the maturity of the obligation secured thereby but not later than 120 days after the last furnishing of labor or materials at the site of the improvement by the person claiming the lien.

Under North Carolina law judgment liens expire ten years from entry of the judgement.
